They questioned the ministry's choice to ignore AIPA's application submitted in October 2024 while simultaneously granting NSF status to a newly established organization formed in November 2024. The Bench sought clarification on how the new body was exempted from essential eligibility criteria outlined in the National Sports Development Code (2011), especially since AIPA's application had not been formally rejected.

Court Orders Comprehensive Review

The Division Bench instructed the Union of India to present the complete original documentation related to the assessment of all NSF applications. The court emphasized that AIPA should be afforded a fair chance to submit written arguments and be heard prior to any renewal decisions, with NSF recognition set for renewal in April/May 2026. The court also specified that the case must be reconsidered without bias from previous judgments, ensuring the rights of all involved parties are maintained. The next hearing is scheduled for May 11, 2026.

In contrast, the competing organization was formed only in late 2024, shortly after AIPA's application was submitted, and received exemptions from critical eligibility requirements, such as the three-year existence rule and minimum affiliations at state and district levels.
