Interim Relief Granted in Smart Meter Controversy

Shimla

In a recent ruling, Civil Judge Tina Malhotra has provided interim relief to Jaimal Singh, a shop owner, in his legal challenge against the Himachal Pradesh State Electricity Board Limited (HPSEBL). Singh contested a notice that threatened to cut off his electricity supply unless he agreed to install a smart meter.

The interim order, which was issued on July 6 and made public on Wednesday, mandates HPSEBL to restore electricity to Singh’s shop using the existing meter within a span of 10 days.

During the court proceedings, HPSEBL defended its position by stating that the installation of smart meters in commercial properties is in line with state government policy and is required under the Electricity Act of 2003. However, the court noted that while the initiative for smart meters is encouraged, it should not be deemed compulsory.

The court emphasized, "The provisions of the Electricity Act should not be interpreted in a manner that coerces consumers into adopting smart meters or leads to the disconnection of their electricity supply."

It is important to note that this ruling is a temporary measure, and a conclusive decision will be made following a comprehensive hearing on the case.
