Court Rejects Bail Application

The Rouse Avenue Court has dismissed the second bail application of Subhash Chand, who was arrested in a bribery case. At the time of his arrest, Chand was serving as the head of the Narcotics Cell of the Delhi Police in Dwarka. He was apprehended for allegedly soliciting a bribe from an individual to avoid implicating them in a narcotics case.

Arguments Presented in Court

Special Judge (CBI) Vijeta Singh Rawat rejected the bail plea on Wednesday after hearing arguments from both the accused and the CBI lawyers. The court emphasized that while the charge sheet has been filed, it does not automatically grant the accused any advantage. The judge noted the necessity to maintain the integrity of the investigation, stating, "It is still essential to assess the potential for witness tampering."

Missing Evidence and Concerns

The court also highlighted that the CCTV footage from the period in question at the Dwarka Narcotics Cell has not been recovered. As a Delhi police officer, whether suspended or not, the accused holds a significant position in society. Therefore, the concern that he might influence witnesses, some of whom are his colleagues or subordinates, is valid. The court concluded that there are sufficient grounds for keeping the accused in custody, which cannot be deemed punitive.

Defense Claims and Court's Decision

In light of the discussions, the court ordered the rejection of the second bail application. During the debate on the bail plea, the defense attorney argued that Chand is innocent and has been falsely implicated based on assumptions and conjectures, solely because he was in charge of the anti-narcotics cell in Dwarka, where co-accused were under his supervision.
