Assam Government Challenges Telangana High Court's Bail Order in Supreme Court
Assam Government's Legal Action
The Assam government has approached the Supreme Court to contest a recent ruling by the Telangana High Court that granted temporary bail to Congress leader Pawan Khera. The state has filed an appeal to overturn this decision, which allowed Khera a week of interim bail related to a case registered in Assam. This interim protection was granted in connection with allegations made by Khera against Riniki Sharma, the wife of Assam Chief Minister Himanta Biswa Sarma.
Khera had accused her of holding multiple foreign passports and possessing undisclosed assets abroad.
Court's Temporary Relief
The Telangana High Court had provided Khera with limited protection from arrest for a week. However, the Assam government opposed this relief and has challenged the grant of interim bail. Reports indicate that the state has requested the Supreme Court for an expedited hearing on the matter, seeking a prompt review by Chief Justice of India, Justice Surya Kant.
Background of the Case
Following his comments about Chief Minister Sarma's family, Khera filed a petition in the Telangana High Court for protection against arrest due to the case registered against him in Assam. On April 5, Khera alleged that Riniki Bhuyan Sharma possessed multiple passports and had assets abroad. He also claimed that these details were not disclosed in the election affidavit submitted by Chief Minister Himanta Biswa Sarma for the assembly elections held on April 9.
Legal Proceedings Against Khera
In light of these allegations, a case was registered against Khera at the Guwahati Crime Branch police station. The complaint includes several sections of the Indian Penal Code (IPC), such as Section 175 for making false statements related to elections and Section 318 concerning fraud. Fearing arrest, Khera filed a petition for anticipatory bail in the High Court on April 7, stating his residential address as Hyderabad and seeking legal protection in case of police action against him.
