Allahabad High Court Halts Demolition of Madina Mosque in Fatehpur District
Court Issues Interim Order on Mosque Demolition
The Allahabad High Court has prohibited officials from demolishing the Madina Mosque in Fatehpur district until the next hearing. This decision was made on Friday as the hearing did not conclude.
Justice Manish Nigam extended the interim order until the next session and scheduled the case for a hearing in the third week of July. The petition was filed by Haider Ali, the president of the Sunni Waqf Madina Mosque Committee, challenging an order regarding illegal construction on village council land.
This order was issued under Section 67(5) of the Uttar Pradesh Revenue Code, 2006. The petitioner's lawyer, SFA Naqvi, argued that the proceedings under Section 67 of the Uttar Pradesh Revenue Code did not comply with the 2013 ruling in the case of Rishipal and Others vs. State Government.
He also contended that the entire process was completed within 26 days, denying the petitioner an opportunity to present evidence in support of their case. While issuing the interim order, the court noted, 'The petitioner's lawyer has argued that no conclusions were recorded regarding the petitioner's objections during the proceedings under Section 67, and the order was passed solely on the basis that the petitioner encroached on village council land. The appeal filed by the petitioner was also dismissed.'
