Allahabad High Court Dismisses Petition Against Uttar Pradesh Cricket Association

The Allahabad High Court has ruled in favor of the Uttar Pradesh Cricket Association (UPCA), dismissing a petition from 'The Cricket Association of Uttar Pradesh' that sought to claim UPCA's assets. Court Ruling on Uttar Pradesh Cricket Association

The Allahabad High Court has ruled in favor of the Uttar Pradesh Cricket Association (UPCA) by rejecting a petition from 'The Cricket Association of Uttar Pradesh' that sought to transfer all of UPCA's assets, accounts, and resources. After reviewing the records, the court noted that during a general meeting held on September 3, 2005, three out of five members of the UPCA Society decided to dissolve the society and transfer its assets, liabilities, and operations to the UPCA established under Section 25 of the Companies Act, 1956. The bench, comprising Justice Atul Srivastava and Justice Siddharth Nandan, dismissed the petition on Monday, deeming it baseless after considering all significant issues raised.

The bench remarked, “The Cricket Association of Uttar Pradesh's claim to be the official or recognized cricket body of the state is misleading and fraudulent. The use of such a similar name is an attempt to create widespread confusion among the public, players, district cricket associations, and other stakeholders.” The court clarified that the only authorized and affiliated entity in Uttar Pradesh recognized by the Board of Control for Cricket in India (BCCI) is the Uttar Pradesh Cricket Association (UPCA).

The bench further explained that the previous society, 'Uttar Pradesh Cricket Association,' was legally dissolved in 2005, and the transfer of all its assets, liabilities, operations, and accounts to the registered Uttar Pradesh Cricket Association under the Companies Act was entirely lawful. The court stated that state government approval was not necessary for this process, as the government failed to demonstrate any financial contribution or vested interest in the former society.

The bench also dismissed the request to prevent UPCA from conducting cricket-related activities in Uttar Pradesh, as well as the demand for a CBI investigation against UPCA. The court rejected the plea to form a high-level committee to investigate UPCA's affiliation with BCCI and the financial assistance it receives. It was formally recorded that UPCA has been a full voting member of BCCI for the past two decades.

UPCA clarified that the petitioner, The Cricket Association of Uttar Pradesh, has not received recognition from BCCI to operate cricket activities officially in the state. Despite this, it has repeatedly attempted to present itself as a recognized cricket body by mimicking UPCA's name.
