Allahabad High Court Dismisses Petition Against Peelibheet Municipal Corporation's Eviction Order

The Allahabad High Court has ruled against the Samajwadi Party's petition challenging the eviction order of the Peelibheet Municipal Corporation. The court noted that the party had already sought relief from a civil court, thus disallowing dual claims. This decision follows a previous rejection by the Supreme Court, which barred the district president from filing a new petition. The party argues that the eviction order was issued without a hearing, raising concerns about procedural fairness. This ruling highlights ongoing legal disputes surrounding municipal governance and party rights.
 

Court's Decision on the Petition

The Allahabad High Court has declined to entertain a petition from the Samajwadi Party challenging the order for the Peelibheet Municipal Corporation's local office to vacate.


While dismissing the writ petition, the bench comprising Justice Ashwini Kumar Mishra and Justice Jayant Banerjee stated that since the petitioner had already approached a civil court regarding this matter, they cannot seek dual relief.


Previously, on June 16, the Supreme Court had rejected the party's petition against the municipal body's decision and prohibited the Peelibheet district president from filing a new petition in this regard.


The party contends that the municipal authority issued the eviction order on November 12, 2020, without providing them an opportunity for a hearing.
