Democrats Poised for Potential House Control in Upcoming Midterms

With the midterm elections on the horizon, predictions suggest that Democrats are likely to gain control of the US House of Representatives. This shift could lead to increased scrutiny of President Trump's trade and tariff policies, which significantly affect India. Polling data indicates a strong Democratic lead, while Trump's approval ratings remain low. A Democratic House could initiate oversight and hearings on various issues, including tariffs and immigration policies. As the election date approaches, the implications for US-India relations and domestic policies are becoming clearer, raising questions about future legislative actions.

Washington, Oct 13: Recent predictions indicate that Democrats are strong contenders to gain control of the US House of Representatives in the midterm elections scheduled for November 3. This shift could lead to increased scrutiny of President Donald Trump's policies on tariffs, trade, and visas, which significantly impact India.

Prediction Markets and Polling Insights

According to traders on the prediction market Kalshi, there is a 90% likelihood that Democrats will secure the House and a 62% chance of winning the Senate, as reported on Monday.

Kalshi also estimates a 61% probability of a Democratic sweep across both chambers, while a divided Congress, with Democrats controlling the House and Republicans retaining the Senate, stands at 30%.

The latest polling average from Silver Bulletin shows Democrats leading by 8.8 points on the generic congressional ballot, which gauges voter support for congressional candidates.

"The upward trend for Democrats that began in early September continues unabated," noted the Silver Bulletin.

Trump's Approval Ratings and Senate Uncertainty

President Trump's approval ratings provide little reassurance for his party. A CBS News/YouGov poll conducted from September 30 to October 2 revealed that only 39% of Americans approve of his performance, while 61% disapprove.

Regarding inflation, approval ratings are even lower, with just 29% in favor and 71% against.

The Senate races present a more unpredictable landscape, with the Cook Political Report identifying seven races as toss-ups: Alaska, Iowa, Kansas, Maine, Michigan, Ohio, and Texas, six of which are currently held by Republicans.

Implications of a Democratic House

If Democrats gain control of the House, they would acquire subpoena power and leadership of committees. Reports suggest that House Democrats are preparing a comprehensive oversight agenda targeting Trump, his family, and his administration.

According to the London-based think tank Chatham House, even if Democrats only control the House, their influence over financial matters would be significant.

With the US debt limit projected to be reached by mid-2027, a Democratic House would prevent Republicans from using budget reconciliation to raise it, as noted by Max Yoeli, a senior research fellow at Chatham House.

Yoeli also warned that opposition to foreign policy would likely focus more on optics than on substantial constraints, given that Democrats would not have enough votes to override presidential vetoes.

Impact on India and Trade Policies

For India, a Democratic-controlled House may primarily influence oversight rather than enacting new legislation.

Trump's tariffs have largely been implemented through executive orders. While a Democratic House could initiate hearings and votes on these tariffs, reversing them would be challenging without bipartisan support.

This situation also applies to the Graham Act tariffs on major purchasers of Russian energy, which are set to take effect on October 18. The law mandates that the administration provide Congress with a written justification at least ten days prior to imposing such duties, a requirement that a Democratic-led House would likely emphasize.

Any trade agreement between India and the US requiring legislative approval would also face increased skepticism in a Democratic House.

The $10,000 fee on new H-1B petitions, which significantly affects Indian professionals, is currently entangled in legal disputes. A federal judge in California blocked its enforcement on September 30, and the administration has appealed to the Ninth Circuit.

Democrats could introduce hearings and spending riders related to this legal battle, as Indian nationals have historically represented the largest group of H-1B beneficiaries.

Among the four Indian-American members seeking re-election to the House—Ro Khanna, Ami Bera, Pramila Jayapal, and Suhas Subramanyam—all are Democrats in races deemed safe for their party.

The current House comprises 435 voting members, with a majority requiring 218 seats. All House seats and 35 Senate seats will be contested on November 3.
