Allegations Against Will Smith

Los Angeles: A tour violinist has filed a lawsuit against Will Smith, alleging sexual harassment, wrongful termination, and retaliation.

The plaintiff, Brian King Joseph, names both Smith and Treyball Studios Management in the legal action, claiming that Smith exhibited 'predatory behavior' and was 'deliberately grooming' him for sexual exploitation during the 'Based on a True Story: 2025 Tour' earlier this spring.

According to the lawsuit, Joseph was hired by Smith in November 2024 for a performance in San Diego and was later invited to join the 2025 tour and contribute to Smith's upcoming album.

As their professional relationship developed, Smith reportedly expressed to Joseph that they shared a unique connection, stating, 'you and I have such a special connection, that I don’t have with anyone else.'

Joseph, who gained recognition from competing on 'America’s Got Talent,' participated in the initial leg of Smith’s tour starting in March 2025, which included a show in Las Vegas where accommodations were arranged for the band and crew.

The lawsuit details an incident where Joseph's bag, containing his hotel room key, went missing for several hours before being returned by management, who were the only ones with access to his room.

Upon returning to his room that night, Joseph discovered that someone had unlawfully entered, leaving behind personal items, including wipes, a bottle of HIV medication labeled with another person's name, and a note that read, 'Brian, I’ll be back no later (sic) 5:30, just us (drawn heart), Stone F.' Joseph interpreted this as a threat indicating that an unknown person would return to his room for sexual activities.

He promptly alerted hotel security and Smith's representatives, also reporting the incident to a non-emergency police line.

Shortly after, a member of the management team allegedly reprimanded him for the situation, suggesting that he fabricated the events and subsequently terminated his employment.

The lawsuit claims that Joseph has since experienced PTSD and financial losses due to his termination. He is seeking damages for retaliation, wrongful termination, and sexual harassment, with a jury to determine the compensation.
