Thalapathy Vijay Challenges Income Tax Penalty


Actor and politician Thalapathy Vijay has formally contested a ruling from the Madras High Court that upheld a hefty income tax penalty of Rs 1.5 crore against him. He has submitted an appeal to a division bench of the Madras High Court, challenging the decision made by a single judge. This appeal, lodged in March 2026, is still awaiting processing for a hearing. The initial ruling dismissed Vijay’s petition, affirming that the penalty imposed by the Income Tax Department was within the statutory timeframe stipulated by the Income Tax Act.


Vijay's Legal Battle Continues


As reported by legal sources, this case emerged following Vijay's tax assessment for the fiscal year 2015-16, which was prompted by a search conducted by the Income Tax Department on September 30, 2015. During this search, Vijay admitted in a sworn statement to receiving Rs 15 crore in cash as part of his remuneration, alongside Rs 16 crore through bank transactions. This undisclosed income was later included in his tax return. The assessment also scrutinized an expense category labeled 'Release And Rasiggar Madram Expenses,' where Vijay claimed Rs 2.92 crore. His representative indicated that Rs 2 crore was directly paid by the film's producer to fan club members in Tamil Nadu and Puducherry, while Rs 92.44 lakh was disbursed in cash by Vijay himself.



The assessing officer disallowed the Rs 2 crore claim due to insufficient evidence and permitted only a portion of the cash expenditure. The Commissioner of Income Tax (Appeals) provided some relief to Vijay, and the Income Tax Appellate Tribunal ultimately approved 50% of the claimed expenses. However, penalty proceedings were initiated under Section 271AAB, which pertains to penalties in search cases. The department levied a penalty of Rs 1.5 crore, which is 10% of the undisclosed income of Rs 15 crore. Prior to the court's ruling, Vijay limited his challenge to the issue of limitation, arguing that the penalty order dated June 30, 2022, was beyond the six-month limitation period specified in Section 275(1)(c). The single judge dismissed this argument and upheld the penalty, noting that the ITAT order was issued on December 22, 2021, and the six-month period concluded on June 30, 2022, the same day the penalty order was issued. The court concluded that the order was timely and found no grounds for interference.
