Tamannaah Bhatia's Legal Battle with Power Soaps Concludes Unfavorably

In a recent ruling, the Madras High Court dismissed actress Tamannaah Bhatia's appeal for ₹1 crore in damages against Power Soaps Limited. The court upheld a previous decision that found her claims unsupported by credible evidence. The legal dispute, which dates back to 2008, centered around the unauthorized use of her images after the expiration of an endorsement agreement. Despite her claims of harm to her professional prospects, the court found insufficient evidence to support her case, leading to the dismissal of her appeal and request for an injunction.
 

Court Dismisses Tamannaah Bhatia's Appeal


Actress Tamannaah Bhatia has faced a significant setback as the Madras High Court has rejected her appeal for ₹1 crore in damages against Power Soaps Limited for the alleged unauthorized use of her images. This ruling effectively concludes a prolonged legal dispute, with the court affirming a previous decision that deemed her claims unsupported by credible evidence.


According to reports, the controversy involving Tamannaah and Power Soaps dates back to 2008 when she signed an endorsement agreement allowing the company to utilize her images for promotional purposes for one year, set to expire in October 2009. Tamannaah contended that issues arose after the contract lapsed, as the company allegedly continued to use her likeness on product packaging and advertisements throughout 2010 and 2011 without her permission.



Tamannaah claimed that this unauthorized use not only breached the contract but also adversely affected her career opportunities, as she was negotiating with rival brands at the time. Consequently, she sought ₹1 crore in damages and a permanent injunction to prevent further use of her images.


However, the case encountered significant challenges in court due to the quality of evidence provided. The initial judge scrutinized the materials submitted by Tamannaah, including product wrappers and online listings, but found them unreliable and insufficient to prove that Power Soaps had continued using her images after the contract ended. There was a lack of clear evidence linking the alleged advertisements or products to the company during the disputed timeframe.



As a result, the judge dismissed Tamannaah's lawsuit, stating that her claims lacked substantiation. The court also denied her request for an injunction, concluding the case with costs. Dissatisfied with the single judge's ruling, Tamannaah appealed to a Division Bench of the Madras High Court, which included Justices P Velmurugan and K Govindarajan Thilakavadi. After reviewing the case, the Division Bench found no grounds to overturn the earlier decision, agreeing that Tamannaah had not demonstrated that Power Soaps used her images beyond the contractual period.
