Supreme Court Steps In for Family Trust Mediation
New Delhi: The Supreme Court has scheduled a hearing for May 14 regarding a petition from Rani Kapur, the mother of the late industrialist Sunjay Kapur. She is requesting the court to prevent his wife, Priya Kapur, and others from interfering with the operations of the 'RK Family Trust' while mediation is ongoing.
On May 7, the court appointed former Chief Justice D Y Chandrachud to mediate the ongoing dispute between Rani Kapur, aged 80, and Priya Kapur concerning the family trust.
The issue was brought before Justices J B Pardiwala and Ujjal Bhuyan on Tuesday.
The bench remarked, "It seems we have entered a situation where even the Mahabharata would seem minor," as they set the date for the hearing.
In her latest application, Rani Kapur claims that Priya Kapur and others are trying to take control of certain companies and assets associated with the contested family estate.
She expressed concerns that there might be attempts to sell or transfer these assets during the mediation process.
Rani Kapur is seeking a court order to stop Priya Kapur and others from interfering with the trust's operations and the related companies while mediation is in progress.
The Supreme Court emphasized on May 7 that all parties should approach mediation with an open mindset.
"We urge all parties to refrain from making public statements or posting on social media. Since this is a family matter, the goal should be to resolve the disputes swiftly and conclude the matter," the bench stated.
They indicated that resolving the issue through mediation would be beneficial for everyone involved, as prolonged litigation would be undesirable.
The court clarified that the mediation would focus solely on the current dispute.
On April 27, the court had suggested mediation due to the nature of the family conflict.
"Today, all legal representatives have graciously agreed to pursue mediation," the bench noted on May 7.
"We will await a preliminary report from the mediator before proceeding further," they added, scheduling the next hearing for August 6.
On April 27, the court requested responses from Priya Kapur and others regarding Rani Kapur's lawsuit, which seeks to declare the family trust "null and void."
The bench issued notices to Priya Kapur and others concerning Rani Kapur's allegations that the trust, established in her name in October 2017, was based on "forged, fabricated, and fraudulent" documents.
Legal battles over the estate and assets are currently ongoing in the Delhi High Court, with the Supreme Court petition seeking to maintain the status quo on the trust's properties.
During the April 27 hearing, the Supreme Court encouraged the parties involved in the Sona Group Family Trust dispute to consider mediation.
In her lawsuit, Rani Kapur is asking for a permanent injunction against Priya Kapur and others, including her grandchildren, from using or acting on behalf of the "RK Family Trust" in any capacity.
Her application asserts that she is the sole beneficiary of her late husband Surinder Kapur's estate, who was the founder of various businesses, including the 'Sona Group of Companies'. She claims that a "systematic fraud" was perpetrated against her when the assets were transferred to the 'RK Family Trust'.
The application states that until his death, Sunjay never confirmed to Rani that she had been stripped of her rights, assets, and legacy, nor did he provide her with a copy of the alleged RK Family Trust.
"Through a complex series of illegal transactions involving the defendants, including Priya Kapur, in collusion with the plaintiff's deceased son, Sunjay Kapur, all of the plaintiff's assets were transferred to a fraudulent trust named the RK Family Trust without her knowledge," the lawsuit claims.
Sunjay Kapur passed away on June 12 after collapsing during a polo match in England, reportedly due to a cardiac arrest.
Additionally, a challenge to the validity of the purported will of their late father by Karisma Kapoor's children is also pending in the Delhi High Court, with the children accusing Priya Kapur of being "greedy."
