Legal Issues Surrounding The Kerala Story 2

Vipul Amrutlal Shah's forthcoming film, The Kerala Story 2, is facing legal hurdles. Three petitions have been filed in the Kerala High Court, claiming that the film's promotional materials portray the state negatively and could incite violence. One of the lawsuits, initiated by Sreedev Namboodiri from Kannur, argues that the teaser and trailer contain elements that could provoke unrest. Another petition, submitted by Freddie V Francis, seeks to prohibit the film's release and contests the inclusion of the state's name in the title. A third petition from Advocate Atul Roy also questions the film's certification and title.

Court's Inquiry into The Kerala Story 2

Why is The Kerala Story 2 in court?

On February 24, the Kerala High Court scrutinized the Central Board of Film Certification (CBFC) for approving a certificate for The Kerala Story 2 - Goes Beyond. Justice Bechu Kurian Thomas indicated that the court would view the film to assess the petitions that raised concerns about potential communal discord. The judge noted that Kerala is a secular state and expressed that the film's claims of being based on real events warranted serious consideration of the lawsuits.

Producers Respond to Legal Concerns

The producers' representative presents his narrative

Senior Advocate S Sreekumar, representing the film's producers, stated in court that the teasers could be removed pending the court's decision. However, the filmmakers clarified in an official statement that their promotional content remains active on social media. They emphasized, “The matter is currently sub judice. No court has ordered the removal of any content. We have not deleted any material. Both the teaser and trailer of The Kerala Story 2 – Goes Beyond are still available on our official platforms. We urge media outlets and individuals to avoid spreading unverified information, as it leads to unnecessary confusion.”

Potential Screening for the Court

The Kerala Story 2 to be screened for Kerala High Court?

During the court proceedings, the film's representative mentioned that it would be screened for Justice Kurian, who acknowledged that while the court typically respects artistic freedom, the film's religious themes necessitate careful consideration. After a brief recess, the court awaited a suitable time for the screening from the producers and CBFC. However, Sreekumar argued that the court should first determine whether the petitions are public interest litigations or private litigations.
