Kerala Court Orders FIR Against Actor Tini Tom Following Ansiba Hassan's Complaint
Court Directs Police to Investigate Allegations
A court in Kerala has instructed the police to file a First Information Report (FIR) in response to actor Ansiba Hassan's allegations against fellow actor Tini Tom. This decision comes as a significant relief for the Drishyam star, especially after the police previously chose not to pursue criminal action. According to reports, the Judicial First Class Magistrate VIII in Ernakulam mandated the Station House Officer at Kadavanthra Police Station to look into Hassan's claims, noting that there appeared to be a prima facie case that warranted further investigation.
Magistrate Kavya Soman issued this order following a private complaint from Hassan, who alleged that the police had failed to act on her claims. She accused Tini Tom of making derogatory comments, including calling her a "jihadi" and using terms like "double-daddy syndrome" and "issue with DNA." Upon reviewing the police report, which acknowledged Tom's use of these phrases but deemed them playful and lacking criminal intent, the Magistrate found the report insufficient. She stated that the determination of criminal intent could only be made after a comprehensive investigation.
The court emphasized that a thorough investigation and evidence collection were necessary to ascertain whether the alleged comments constituted criminal offenses. Acknowledging the existence of a prima facie case, the Magistrate directed that the complaint be forwarded to the Kadavanthra Police Station for investigation under Section 173(5) of the Bharatiya Nagarik Suraksha Sanhita (BNSS). The complaint cites offenses punishable under various sections of the Bharatiya Nyaya Sanhita (BNS) and Section 119(a) of the Kerala Police Act. Additionally, witness statements from the preliminary inquiry were noted, including one from actor Neena Kurup, who indicated that Tini Tom had made similar remarks about Hassan at the AMMA office in Kaloor. Kurup also mentioned that AMMA president Swetha Menon had informed her that Tom had made comparable comments to her as well. With this ruling, the police are now mandated to register an FIR and conduct a thorough investigation into the allegations against Tini Tom.
