Dhurandhar 2: Legal Battle Fails to Halt OTT Release

Dhurandhar 2, the sequel to the hit film, is embroiled in a legal controversy as filmmaker Santosh Kumar claims the script was plagiarized. Despite his efforts to halt the film's digital release, a Mumbai civil court has ruled in favor of the film, allowing it to premiere on OTT platforms. The court's decision highlights the lack of evidence presented by Kumar and emphasizes the potential harm to the film's creators if the release were to be delayed. With the film now streaming on JioHotstar, audiences can enjoy the much-anticipated sequel without interruption.

Dhurandhar 2 Faces Legal Challenge

Dhurandhar: The Revenge, also known as Dhurandhar 2, is currently in the spotlight not just for its box office performance but also due to a legal controversy. Filmmaker Santosh Kumar has accused the creators of the film of plagiarizing his script. In an attempt to prevent the film's digital release, he filed a petition in a Mumbai civil court for an interim stay. However, the court rejected his request, allowing the film to proceed with its OTT launch. The court provided several reasons for its decision, which are crucial for understanding the implications for Aditya Dhar's much-anticipated sequel.

Court Decision on OTT Release

Dhurandhar 2 OTT Release Approved

Director Aditya Dhar has received a significant legal victory as the Mumbai civil court dismissed the request to halt the OTT release of Dhurandhar 2, featuring Ranveer Singh. The filmmaker Santosh Kumar had sought an ad-interim injunction, claiming that parts of his original script were incorporated into the sequel. Nevertheless, the court allowed the film's OTT release to continue as planned. According to the court's ruling dated June 4, Kumar had previously submitted a similar request to the Karnataka High Court, which was dismissed, permitting him to pursue appropriate legal remedies elsewhere. The Mumbai court highlighted that this issue was not addressed in the current case, stating, “But that fact was not disclosed by the plaintiff, that will prima facie show that he has not come with clean hands.”

Lack of Evidence in Court

Mumbai Court Highlights Evidence Gaps

The court also took into account the defense's argument that Kumar had sought action against an OTT platform without including any streaming service in the lawsuit. Additionally, it was noted that no comparative evidence was provided to illustrate the similarities between Kumar's screenplay and the film. The court remarked, “From the plaint and documents, no such comparison was produced by the plaintiff to show the similarity of script and dialogues and unless and until that is verified, the relief of injunction and appointment of the Court Commissioner cannot be granted.”

In rejecting the plea, the court concluded that granting an interim stay would inflict greater harm on the defendants, particularly since rights related to the film had already been assigned to third parties. “Hence, if ad interim relief is granted in favour of plaintiff, it will cause irreparable loss to the defendants. If the plaintiff succeeds in the suit, he can claim compensation; hence no irreparable loss would be caused to him,” the court stated. Following this ruling, Dhurandhar 2 featuring Ranveer Singh was released on OTT on June 4 and is now available for streaming on JioHotstar.
