Legal Battle Surrounds Dhurandhar: The Revenge
Dhurandhar: The Revenge, also referred to as Dhurandhar 2, is making headlines not just for its box office success but also due to a legal dispute. Filmmaker Santosh Kumar has alleged that the film's script is based on his original work. In an attempt to prevent the film's digital release, he filed for a temporary injunction in a Mumbai civil court. However, the court dismissed his request, allowing the film to proceed with its OTT launch. The court provided several justifications for its decision, shedding light on the implications for Aditya Dhar's eagerly awaited sequel.
Dhurandhar 2's OTT Launch Approved
Director Aditya Dhar received a positive outcome when the Mumbai civil court rejected the request to delay the OTT release of Dhurandhar 2, featuring Ranveer Singh. This came amidst allegations that the film's script was plagiarized. Santosh Kumar sought a temporary injunction against the digital release, claiming that elements of his original script were used in the sequel. Nevertheless, the court opted not to grant interim relief, allowing the film's OTT debut to go ahead as scheduled.
According to the court's ruling dated June 4, Kumar had previously made a similar request to the Karnataka High Court, which dismissed his petition and permitted him to seek appropriate remedies in the correct jurisdiction. The Mumbai court highlighted that this issue was not addressed in the current case, stating, “But that fact was not disclosed by the plaintiff, which prima facie indicates that he has not approached the court with clean hands.”
Mumbai Court Points Out Lack of Evidence
The court also considered the defense's argument that Kumar sought orders against an OTT platform without including any streaming service in the lawsuit. Furthermore, it was noted that no comparative evidence was presented to demonstrate the similarities between the plaintiff's screenplay and the film. “From the plaint and documents, no such comparison was presented by the plaintiff to demonstrate the similarity of script and dialogues, and until that is verified, the relief of injunction and appointment of the Court Commissioner cannot be granted,” the order stated.
In denying the plea, the court concluded that granting a temporary stay would cause more harm to the defendants, especially since rights related to the film had already been established in favor of third parties. “Therefore, if interim relief is granted in favor of the plaintiff, it will lead to irreparable loss for the defendants. If the plaintiff prevails in the lawsuit, he can seek compensation; thus, no irreparable loss would be inflicted upon him,” the court stated.
Following the ruling, Dhurandhar 2, starring Ranveer Singh, premiered on OTT on June 4 and is now available for streaming on JioHotstar.
