The Bombay High Court has recently made important remarks regarding a legal battle involving Bollywood icon Salman Khan and his neighbor in Panvel, Maharashtra. During a session concerning a defamation lawsuit initiated by Khan, the Court emphasized that having access to social media does not grant individuals the liberty to disseminate potentially defamatory content about others, regardless of whether they are private citizens or public figures. This case arises from a prolonged property dispute between Khan and his neighbor, Ketan Kakkad, who has made various allegations against the actor through posts on social media and YouTube videos.

High Court Urges Removal of Allegations

These comments were made during the hearing of an appeal by Salman Khan at the Bombay High Court, as reported by a legal news outlet. The actor contested a civil court's decision that denied him temporary relief in his defamation case against Kakkad. Justice Sharmila Deshmukh, who oversaw the proceedings, stated that conflicts should not be resolved on social media and encouraged the parties to pursue legal remedies instead. The Court advised Kakkad to consider removing the posts and videos related to the dispute.

The Bench also raised concerns about the ongoing dissemination of such material online, indicating that judicial resources should not be wasted on determining the accessibility of videos and social media posts. Furthermore, the Court pointed out that even if content is uploaded by third parties, there are available mechanisms through intermediaries and online platforms to request its removal. This stance reflects the Court's belief that social media should not serve as an alternative venue for resolving personal or property disputes. The case is scheduled for further hearing on July 6.

Background of the Defamation Case

The conflict originates from adjacent properties in Panvel, where Salman Khan's farmhouse is located. Ketan Kakkad has accused Khan of breaching environmental laws and obstructing access to his property. Kakkad claims he reported these issues to the relevant authorities, but no action was taken despite his complaints. Following this, Kakkad took to social media, posting numerous tweets and participating in YouTube interviews to discuss the dispute and make allegations against the actor.

In response, Salman Khan initiated a defamation lawsuit, asserting that Kakkad's statements were damaging to his reputation. The actor further argued that some of the online content was not only defamatory but also incited communal tensions. Khan contends that the situation intensified after a proposed land deal involving a plot next to his farmhouse was annulled by authorities due to alleged irregularities. He claims that following this cancellation, Kakkad began to make unfounded allegations suggesting that the decision was influenced by Khan and his family.

Conversely, Kakkad has resisted the defamation claims, maintaining that his statements are factual regarding Khan's property and thus do not amount to defamation. His legal representatives have also argued that as a public figure, Salman Khan has made details about the property public.
